In these Terms and Conditions, “SAS JET-VIP.COM” shall mean any entity of SAS JET-VIP.COM.

  1. Network:

    SAS JET-VIP.COM operates a website or mobile app (the “Network”) that serves as a marketplace for air charter services for users of air charter services (the “Charterers”). The Network may provide quotes for air charter services offered by third-party aircraft operators (the “Operators”). Your access to and use of the Network is governed by these Terms and Conditions, and you agree to use the Network only in accordance with these Terms and Conditions. You may use the Network only to make legitimate requests to book services offered by the Operators (the “Requests”). SAS JET-VIP.COM reserves the right to modify these Terms and Conditions at any time, and your continued use of the Network will be governed by the Terms and Conditions in effect at the time of such use.
  2. Role of SAS JET-VIP.COM:

    SAS JET-VIP.COM acts as an air charter broker and only serves as an intermediary between the Operators and the Charterers. SAS JET-VIP.COM arranges carriage by air by chartering aircraft from the Operators, acting as an agent, in the name and on behalf of the Charterers.
    SAS JET-VIP.COM does not own, operate, maintain, or charter aircraft and does not provide air transportation services.
    There is no carriage or charter agreement between SAS JET-VIP.COM and the Charterers and/or the passengers.
    SAS JET-VIP.COM is not a party to the carriage or charter agreements between the Operators and the Charterers and shall not bear any obligation or liability in relation thereto. These Terms and Conditions are not a contract for air transportation, and no such contract is or will be entered into between you and SAS JET-VIP.COM.
  3. Booking of Services:

    Booking any air charter services (and any related services) through SAS JET-VIP.COM will be subject to and governed by an Aircraft Charter Brokerage Contract to be entered into between you and SAS JET-VIP.COM. The Network is not an offer to contract, and neither a Request nor any proposal sent by SAS JET-VIP.COM in response to a Request shall be considered an offer to contract. SAS JET-VIP.COM reserves the right to refuse to provide its services to any person or entity in its sole discretion.
  1. Use of the Website:

    You confirm and guarantee that you have the legal age and capacity to enter into binding agreements, such as these Terms and Conditions, any Aircraft Charter Brokerage Contract and any Carriage Agreement (which may be entered into between you, represented by SAS JET-VIP.COM, and any Operator).
    You also confirm and guarantee that no restrictions apply to you that would prevent you from entering into or fulfilling any such agreements.
    Your requests must not be speculative, false, or fraudulent.
    You cannot make any requests or agreements on behalf of a fictitious user, under a false name, with an invalid credit card or by using any other fraudulent information.
    Please note that fraudulent users will be prosecuted and may face civil and criminal liability, depending on applicable law.
    You cannot use the Website to submit requests or enter into agreements for or on behalf of third parties unless you are legally authorized to do so.
    You expressly agree that your use of the Website is solely at your own risk and expense.
  2. Termination of Usage:

    SAS JET-VIP.COM may suspend your access to all or part of the Website at any time at its sole discretion, with or without notice and with or without reason.
  3. Ownership of Information:

    You acknowledge and agree that all materials and information contained on the Website, including data, software, photographs, images, videos, graphics, sounds, quotes, written and other materials (the “Materials”), are the property (including intellectual property) of SAS JET-VIP.COM or have been licensed to SAS JET-VIP.COM.
    You cannot use, copy, distribute, or misappropriate any material without the prior written consent of SAS JET-VIP.COM. However, you are allowed to print and copy portions of the Website, including these Terms and Conditions, for the sole purpose of using the Website as a shopping resource, in accordance with these Terms and Conditions.
  4. Disclaimer of Warranties and Exclusion of Liability for SAS JET-VIP.COM

    Any information of any kind whatsoever which is provided in or accessible through the SAS JET-VIP.COM network is for informational purposes only and provided or accessible without any express or implied warranty of any kind. Specifically, SAS JET-VIP.COM makes no warranty regarding:

    (A) the accuracy, reliability, completeness, correctness, topicality, or quality of any information provided
    (B) the handling and/or acceptance of any request
    (C) the entry into any Aircraft Charter Brokerage Contract between SAS JET-VIP.COM and any Charterer
    (D) the entry into any Carriage Agreement between any Operator and any Charterer
    (E) the availability of services through the SAS JET-VIP.COM network and/or
    (F) the accessibility, functioning, and/or error-free nature of the SAS JET-VIP.COM network.

    To the fullest extent permitted by applicable law, SAS JET-VIP.COM and its shareholders, partners, affiliates, officers, directors, employees, agents, representatives, servants, auxiliaries, successors, and assigns disclaim all liability for any injury, damage, death, loss, accident, or delay arising from or in connection with:

    (A) these terms and conditions
    (B) its activities and/or services hereunder
    (C) the SAS JET-VIP.COM network and any information provided or accessible through it
    (D) any use of the SAS JET-VIP.COM network or any issue related thereto
    (E) any handling or non-handling of a request and
    (F) any services obtained through the SAS JET-VIP.COM network.

    8. Indemnification for SAS JET-VIP.COM

    By using the SAS JET-VIP.COM network, you agree to be liable for and shall indemnify SAS JET-VIP.COM, its shareholders, partners, affiliates, officers, directors, employees, agents, representatives, servants, auxiliaries, successors, and assignees, as well as any other person (including any Operator and any owner, lessee, or financier of any aircraft) (the “Indemnitees”), against any direct or indirect damage (including reasonable attorneys’ fees):

    (A) resulting from or in connection with any breach by you of these terms and conditions (including any representation or warranty by you herein), any other agreement, or any applicable laws, regulations, orders, demands, and travel requirements (including immigration and customs regulations) or
    (B) relating to your actions or omissions in the name and/or on behalf of any third party, including your failure to inform such third parties of, or cause them to comply with, all terms and conditions applicable to services acquired through the SAS JET-VIP.COM network.

    9. Personal data

    Personal data is processed by SAS JET-VIP.COM at 2 avenue Jean Monnet, 26000 Valence in accordance with the Privacy Policy available on the Network.

    10. Miscellaneous

    These Terms and Conditions constitute the entire agreement between you and SAS JET-VIP.COM relating to your use of the Network and supersedes any prior or contemporaneous understandings or agreements (whether oral or written) regarding the subject matter. No variation of these Terms and Conditions by you shall be effective unless agreed in writing by SAS JET-VIP.COM. Where the context permits, the use of the singular herein shall include the plural and vice versa, and the use of the neutral or masculine personal pronoun shall include both masculine and feminine genders.
    Unless otherwise provided herein, the term “or” is not exclusive and “include”, “including” and “in particular” are not limiting.

    11.  Governing Law and Jurisdiction

    Any dispute, controversy, or claim arising out of, or in connection with, these Terms and Conditions, including the validity, invalidity, breach, or termination hereof, shall be submitted to the exclusive jurisdiction of the courts of Romans, France, to which the parties hereby irrevocably agree to be submitted.
    The foregoing shall not prevent SAS JET-VIP.COM to sue any Charterer before any other competent court.
